If you’re facing a DUI charge, we know that the situation can be extremely difficult. You might have kids, a long commute, and responsibilities to your community. Because of this, re-obtaining your license is probably at the top of your list of concerns. A DUI carries big penalties; the largest of which being your license’s suspension. But, we need cars to get through our day-to-day responsibilities, so what can you do? And what steps can you take towards getting your back on the road as quickly as possible?
Re-Obtaining Your License After DUI
First, remember that law enforcement suspends your driving privileges even before a conviction if you’re suspected of DUI. If you refuse a breathalyzer, or chemical test, police suspend your license immediately. You will also face immediate suspension if your BAC is at or above .15%. In this situation, you have thirty days to appeal. But, if you don’t, you must attend an alcohol or drug rehab program.
Temporary Licenses
If you’re dealing with a suspension, you have the option to apply for a temporary restricted driver’s license. The temporary licenses will allow you to drive anywhere in South Carolina before your hearing. To obtain your temporary license, you need to schedule a hearing. Then, you must pay about $3o0 in fees and what around 7 days. So, it’s important to prepare ahead of time for this waiting period.
Special Restricted Licenses
Finally, the DMV grants “special restricted licenses” to qualified applicants. These licenses are only for situations where you must have them to get to and from work and/or school. You must demonstrate that your place of work/school is more than one mile away from your home. The license is only for that commute; it is not for general driving.
There are options
Ultimately, a DUI is not ideal but you do have a few options for getting back on the roadway. The court understands that a license is a necessity for some activities, so that’s why they allow a bit of leniency. But, understand that these restricted licenses can be revoked at any point in time if you are caught for another DUI. So, drive safe, drive smart, and in the event of a DUI, do your research so that you don’t miss these deadlines. We wish you luck as you move forward with this charge, and offer our services if you might need them.
